This agreement sets forth the rights and obligations of the parties regarding the delivery of the product (hereinafter referred to as the “Product”) ordered by the Client through the Contractor’s website (www.tesstespih.com), including orders placed via phone or WhatsApp. The Client is deemed to have accepted this agreement by approving it on the Website. Upon such approval, the payment for the ordered Product, including any applicable fees, will be collected through the selected payment method. The date on which the payment is collected shall be considered the “Order Date”.

Article 3 – General Provisions

Products ordered through our website are produced specifically upon the Client’s special requests and personal needs after the Order Date. For this reason, the Client has no right of withdrawal from this Agreement as of the Order Date.

Unless otherwise agreed in writing by the Contractor, the Client must pay the full amount before the delivery of the Product.

In the event that, after delivery, the bank or financial institution linked to the credit card used for payment refuses to pay or reclaims the amount paid to the Contractor, the Product must be returned to the Contractor within 3 days by the Client. In such cases, the return shipping costs shall be borne by the Client. The Contractor reserves all contractual and legal rights, including initiating collection procedures for the unpaid amount, regardless of whether the return is accepted.

Article 4 – Delivery

Unless otherwise stated by the Contractor and except in cases of force majeure, Products ordered will be handed over to the shipping company within 7 (seven) business days from the Order Date for delivery to the address specified by the Client.

The Contractor delivers Products via its contracted shipping company. If this company does not operate in the Client’s area, the Client must collect the Product from the nearest branch designated by the Contractor. Necessary notifications will be made to the Client via email, SMS, or phone.

Shipping companies generally deliver within an average of 5 business days, although this may vary depending on the distance. Unless otherwise stated, delivery/shipping costs are borne by the Client. However, depending on current promotions published on the Website, the Contractor may cover all or part of these costs.

If the Client is not present at the delivery address or if those at the address refuse to accept the Product, the Contractor is deemed to have fulfilled its delivery obligation. It is the Client’s responsibility to follow up with the shipping company in such cases. The Contractor is not responsible for non-delivery to third parties designated by the Client if they are unavailable or refuse to accept the Product.

Any damages or additional costs arising from delayed receipt by the Client or from the Product being returned to the Contractor shall be borne by the Client.

Upon delivery, the Client must inspect the Product and, in case of any defect, refuse acceptance and request a report from the delivery officer. Otherwise, the Contractor will not accept responsibility.

Article 5 – Prior Information Provided to the Client

By approving this Agreement on the Website, the Client declares that they have been informed about the essential characteristics of the Product, the total price including taxes, the delivery time, payment method, and delivery costs (unless otherwise specified, to be borne by the Client), as well as the Contractor’s legal details.

The Client acknowledges that the Product is produced upon special request and personal need, and therefore confirms that they do not have the right to withdraw from the Agreement as of the Order Date.

The Client confirms that they have received complete and accurate information and have provided electronic confirmation. The Agreement is sent to the Client’s email address and can be saved for future reference. Additionally, the Contractor will retain the Agreement for three years. In the event of any disputes arising from this Agreement, the Contractor’s records (including digital and audio records) shall serve as evidence.

Article 6 – Governing Law and Jurisdiction

This Agreement is governed by Turkish Law. In the event of any disputes arising from the performance of this Agreement, the Istanbul Çağlayan Courts and Enforcement Offices shall have exclusive jurisdiction.

Article 7 – Notifications

The email address provided by the Client shall be considered the official address for all notifications related to this Agreement. Any communication sent to this email will be deemed to have been delivered one day after dispatch.

If the Client changes their email address, they must notify the Contractor in writing within 5 (five) days. Otherwise, any communications sent to the previously provided email address shall be deemed valid and binding.

By accepting this Agreement, the Client declares that they have read, understood, and accepted all its provisions, confirm the accuracy of the personal information provided, and consent to receive all further communications from the Contractor.
